1.0 My Home Seeker LLC is Not a Real Estate Broker/Agent/Realtor

My Home Seeker LLC is not a licensed real estate broker in any state in the United States and chooses to remain unlicensed. MyHomeSeeker.com is an advertising service only, and does not knowingly offer or perform any services which require a license. It is the right of any Seller or Buyer of real estate to privately transact real estate without the assistance or services of a real estate broker.

MyHomeSeeker.com is classified as a MLS (Multiple Listing Service or Multiple Listings Service) and intended only as a means by which authorized sellers and agents may advertise property for sale or for rent. The use of the term "MLS" is not an endorsement of the National Association of Realtors(NAR), nor does it indicate any affiliation with that organization. The MyHomeSeeker MLS is not in any way affiliated with NAR or its members in a way that can be considered meaningful under the policies of that organization.

1.1 MyHomeSeeker.com Service Policies

A) MyHomeSeeker.com is a Real Estate listing and advertisement service for residential and commercial properties throughout the United States.

B) MyHomeSeeker.com does not offer any warranty, expressed or implied, with regard to:

1. the validity of information available on the website,
2. the display frequency of listings,
3. the amount of traffic to the website,
4. the amount of traffic to listings,
5. the intention or quality of buyer to seller contact, or
6. the legitimacy of members of MyHomeSeeker.com

C) MyHomeSeeker.com offers the following listing type(s):

1. For Sale Listings
2. For Rent Listings

D) MyHomeSeeker.com offers the following features for all listings:

1. Ability to upload up to 12 property photos,
2. Ability to upload up to six Virtual Tour 360°,
3. Ability to upload a video of the property,
4. Ability to upload multiple floor plans,
5. An html capable property description of up to 3,000 characters,
6. Location details such as street number and name, unit, city, and state,
7. Listing information such as price, availability, square footage, lot size, property type, transaction type(sale or rent), predefined property features, and a unique listing ID number,
8. All listings are given a default expiration date of two years, or 730 days, from the date of creation; after which period has passed, extensions of the listings expiration may be given upon request. A request may be made via the Contact Form. Extensions are granted on all listings that comply with MyHomeSeeker.com policies. By default, an extension will add an additional 730 days to the expiration date. All listings are until either sold or rented without the need for additional payment. The default expiration of 730 days is applied in an attempt to reduce the amount of listings that stay in the database beyond the date that a property is taken off the market.

E) MyHomeSeeker.com does not offer the following:

1. Placement of listing(s) in print, by email, or on any other website
2. Inclusion of listing(s) in the National Association of Realtors Multiple Listing Service(MLS)
3. Guaranteed placement in the sections titled "Random Property For Sale" and "Random Property For Rent", as seen on various pages of this website; inclusion in these sections is based on a random order generated from all listing IDs in the database
4. Guaranteed placement on any page or section of this website reserved for "Recent Listings"; inclusion in these sections is defined first by a maximum number of listings to display, then in chronological order based upon the date the listing was created
5. A promise of safety; it is the responsibility of sellers/buyers to ensure that common sense is used when scheduling meetings for any purpose
6. MyHomeSeeker.com is not liable for the actions of parties using the website
7. MyHomeSeeker.com does not offer any third party affiliations or partnerships, of any kind, to its members unless expressly stated otherwise

F) MyHomeSeeker.com offers three account types. Each account is provided with basic the functionality of contact information, and geographic location. In addition, the following is provided by account type:

1. Owner - This is the standard and default account type on MyHomeSeeker.com; this account type allows for a user photo to be uploaded
2. Realtor - Realtor accounts are given placement into our "Find An Agent" search page, given the ability to enter a company name, upload a company logo, and a user photo
3. Builder - This account type is for easier recognition of Builders, and receives the same functionality as the Owner account type

1.2 MyHomeSeeker.com Payments & Packages

A) All packages available on MyHomeSeeker.com are made so on a first come, first serve basis. All prices may vary with or without notice. For more details on available packages and pricing, visit the Purchase Listings page. You must be logged into an active account to view this page. Alternatively, you may view the pricing per package on the front page of the website located at www.myhomeseeker.com.

B) In addition, MyHomeSeeker.com also offers special discounts and promotions. These promotions, and the rules of use, participation, and issuance, are to be applied and governed solely by My Home Seeker LLC. At no time is any promotion or discount to be guaranteed by MyHomeSeeker.com. My Home Seeker LLC reserves all rights.

C) Promotions and discounts will be announced publicly on the front page of the website, located at www.myhomeseeker.com. During a promotion or discount period in which listings are "Free", no payment or payment information will be requested by My Home Seeker LLC.

D) During any promotion in which listings are offered without payment, your account may be preloaded with a set amount of listings available as prescribed by My Home Seeker LLC. The number of listings made available is an arbitrary number derived with the sole purpose of allowing you to create the listings you need without the need to request more available listings. This number does not entitle you to keep any unused available listings, as only active listings can receive the promotional benefits. Upon closure of the promotion, any unused available listings will be forfeited.

E) All sales are final. Refunds may be given at My Home Seeker LLC"s sole discretion.

F) All Payments are made via Paypal for superior security and reliability.

G) Payments are accepted in electronic form only. Paypal offers the ability to make purchases with a credit card, check(debit) card, Paypal account, and eChecks.

H) All transactions are subject to confirmation of payment. This approval process may vary in length depending on the payment method chosen by the member. Regardless of the time taken to fully verify and process a payment, purchased listings may be made immediately available to the member. Should a payment be declined, for any reason, any and all listings not paid for, or otherwise secured by a promotion or discount, may be deactivated at the sole discretion of My Home Seeker LLC until such a time when a confirmed payment can be made.

I) Pricing for services on MyHomeSeeker.com are displayed clearly and accurately on the "Purchase Listings" page. If you are asked to pay a different amount by paypal, the only payment processing company used by MyHomeSeeker.com, please cancel the transaction and Contact Us immediately.

J) All listings purchased, regardless of package or price, including listings placed during promotional and discount periods, are until sold or rented, depending on the type of transaction desired for the property. Purchasing a package secures a predefined number of ads available to your account. Once a listing has been created, that listing shall permanently count against your total number of available ads. Should you decide to delete a listing at any time and for any reason, the ad slot used by that listing may not be recovered for reuse at any time. Deleting a listing concludes a transaction under the terms of the "Until Sold/Rented" clause of these Terms and Conditions, and shall consequently be subject to the limitations of returns and refunds as prescribed within these Terms and Conditions. MyHomeSeeker.com reserves all rights.

K) All listings have the same limitations placed upon them. These limitations are mandatory and will not be adjusted. The use of features, or lack thereof, will not entitle the seller to any compensation or reimbursement.

2.0 Seller Responsibility

A) A seller is defined as the registered member of MyHomeSeeker.com placing a listing on this website for sale, or for rent. The term seller does not in any way indicate ownership or possession of listed property(s).

B) Seller assumes all responsibility for the accuracy of the information provided in sellers listing(s).

C) Seller assumes all responsibility for the content of the information provided in sellers listing(s). Listings may not contain:

1. Information or links relating in any way to wares, pirated software, or any other illegal product, practice, or activity
2. content that may be considered SPAM, defamatory, or pornographic in nature

Listings found in violation of this policy may be subject to penalty including, but not limited to, cancellation of sellers account and/or listings. A listing/seller will be deemed in violation of this policy solely by My Home Seeker LLC employees and/or management, as will any resulting action taken by My Home Seeker LLC

D) Seller is responsible for correctly updating the status of listings, as needed, in a timely manner. Each listing should be updated to reflect a status of "Available", "Under Offer", or "Sold" accordingly.

E) Seller is responsible for selecting the correct account type upon registration, and updating the account type through the "Edit Profile" page as needed.

F) Seller is responsible for entering a working geographic address for each property listed. Failure to do so may result in the Location Map on the listings page not working correctly. You may obtain the correct address by verifying it at Google Maps and transferring the verified address into a listing. If an address cannot be found by Google, a map cannot be displayed for the listing. MyHomeSeeker.com does not offer any warranty regarding location, and all issues/questions regarding the location maps provided by Google should be directed to Google.

G) Seller may not upload or post content to MyHomeSeeker.com that violates any applicable copyrights. Upon notice, from any party, of a violation of another"s copyrights, seller has 24 hours to correct the content to avoid action and/or penalty issued by My Home Seeker LLC.

3.0 Equal Housing Opportunity

A) MyHomeSeeker.com respects all laws and ideas of the Fair Housing Act, and the U.S. Department of Housing and Urban Development.

B) All listings must adhere to the standards of the Fair Housing Act, as required by law.

C) All members of MyHomeSeeker.com are required to comply with the letter of the law. An owning member of a Real Estate listing on this website that is found to be in violation of the Fair Housing Act may be subject to penalties including, but not limited to, suspension of account, removal of any and/or all of said members listings, and being reported to the U.S. Department of Housing and Urban Development, with or without notice.

D) Visitors that feel a listing on MyHomeSeeker.com is in violation of the Fair Housing Act are encouraged to report the listing/seller to My Home Seeker LLC via the Abuse Contact Form. Additionally, visitors may report violations directly to the U.S. Department of Housing and Urban Development.

4.0 Notice to AOL Members Regarding Email

A) Due to technical incompatibilities with AOL and its Postmaster system, MyHomeSeeker.com strongly suggests the use of any other email service when registering for an account on MyHomeSeeker.com. The issue is one of security as the AOL email system rejects emails from MyHomeSeeker.com, and more specifically its host, as SPAM. Because of this, users may not receive system emails from MyHomeSeeker.com.

5.0 MyHomeSeeker.com Email Policies

A) MyHomeSeeker.com does not, purposefully or passively, condone or participate in bulk email schemes, programs, or practices herein referred to as SPAM. Upon registering for an account on MyHomeSeeker.com, our system sends an automatically generated email to the address specified during registration. This email is an important confirmation and activation email for your new account with MyHomeSeeker.com. AOL Members will not receive this email, please use another email service provider for your account with MyHomeSeeker.com.

B) In the event that a registered member of MyHomeSeeker.com forgets their username or password, or otherwise has difficulty logging into their account, the member may request that an email be sent to the registered email address in our database with the users" log-in details. AOL Members will not receive this email, please use another email service provider for your account with MyHomeSeeker.com.

6.0 Resolution

These terms are subject to change with or without notice. Use of MyHomeSeeker.com constitutes your acceptance of all terms and policies set forth on this webpage. Should you wish to opt out of any terms or policies, your only recourse of action is to wholly terminate all use of this website, and the MyHomeSeeker.com service.
